    Couple of points I disagree,

    1. If we assume them as I485 apps, we also need to take Family numbers into account. So EB2 LCs can only be around 23000.
    2. In 2007, Perm wasn't as hopeless as it is now. So people were getting LCs in less than 3 months.

    So adding all these, here is my break up

    Year LC# EB2 LC Visa #
    2004 12000 5000 11250
    2005 7000 2000 4500

    After you apply for AP its only 1 year H1 increments.



    Can you please clarify on this; If 485 is not current at the time of H1 extension and if 140 is approved should get 3 year extension. How does applying for AP change this? Do you mean using AP when traveling or mere applying of
    AP will make you not eligible for 3 year extensions?

    High time this bill is passed. Too much fraud in L1s and H1s.Existing H1s dont have jobs and our green cards pending and no hope when it will come. They should really make L1 very very hard because I work in a huge wireless company where they get L1s from companies like TCS and they work 15 hours a day with $25 billing rate, because of which all contractors and permenant workes (on H1, GC, EAD etc) are being laid off

    I wish this bill passes with full effect


    Your emotions are understood as we are all in the same boat towards a common goal. Please refrain from making comments that give a perception to people who read it as if the whole system is rotten, it doesnt help yours and our cause..thanks for your understanding.:).. and lastly please dont name companies either. Its just doesnt help.

    Outsourcing cannot be stopped with these nonsense bills . Outsourcing can only be stopped when the US market relizes that it is highly overpriced for the same job that is doine abroad for a far lesser price and adjusts accordingly . Every work has a value associated to it and the price needs to be paid according to the value of the work and not the place it is done ( India or the US )

    Lets take a example of a barber. The barber in India charges about Rs 30 ( 45 Cents ) whereas for the same task a barber in US charges about $ 15 ( Rs750 ) . Now the question is , is the barber in the US more skilled than the barber in India , or the Barber in US doing a job if much more value than the barber in India . The reason that the barber is charging more is simply because of the virtue of the fact that he is in the USA and nothig else .

    In the same way the Software Consultants ( Indian or Americans ) who are getting paid more in the USA , pleas remember that the reason for the extra salkary is not because we are more skilled or do better value work . It is simply because of the virtue of being located in the USA and nothing else .

    Now instead of frowing and looking down upon the people who do the same value work for less , we need to be appreciative of their competative spirit . They work hard , so the same work , get paid less and compete with us . Whats not to appreciate of that ? Is this not the way the American dream is made . These senators instead if introducing a price correction in the US to bring down the rate of work in US are trying protectionism tactics to prevent people from selling the same work at alower rate . The result will be what hapenned to GM and Ford and Chrysler .These contractors that these companies negotiated with their staff has resulted in their downfall . GM staff drinks beer outside a closed plant and still the UAW contract entiles them to $94.00 per hour . GM and ford though that American consumers will protect them from Honda and Toyota which had much cheaper workes ( on flexible rates ) and made much better cars . The Durbin Grassley amendment will result in the same fate to other american compoanies that happenned to GM and Ford .

    Pappu,
    Why dont you organize a rally, we will contribute and be their for the rally. We need to do something ASAP. I humbly request you and other core members to organize a rally and pick one day for sending flowers to either white house or USCIS. Also we can balck out our personal information and send our transcripts as well.

    Please organize a date, how about February14th, we will get more attention. Love for permanent residency, media will like the idea and broadcast it.

    What about hunger strike?
    It is much bigger than rally. You will get more attention and you do not need thousand people to do it. If we can have even a handful of people or even one person to do it, it will be great. The expenses and preparation to do hunger strike will be very less.

    I am not sure if its legal or not but various members can contribute their skills in exchange of donation to IV. This way members with skills are giving their time to IV and Members of the forum are getting sound advice/guidance/service for small contribution to IV.     I hope you are not joking here, did you try to port your EB-3 date to some old PD or change from EB-3 to EB-2?

    I am surprised how come PD is not current and USCIS denies I-131 based on the grounds that I-485 approved.

    Something is definitely wrong here, unless its USCIS system glitch which considers the preadjudicated (pre-approved) cases as approved and then deby subsequent benefits associated with AoS (I-485) pending application.

    Very interesting news for the IV community. Keep us posted on the new developments.

    There are 3 bills in congress that will reduce the backlog in EB3. Thats quite an achievement because no matter what bright ideas we might have in this forum, getting the representatives in congress to adopt the "language" for the bills is very hard.

    So, lets take advantage of what we have in our plate right now. We need the support of CHC members. So call them. And also call your local representatives.

    This is the best option we have right now. Lets do our best. Make the calls.

    As per my research, this restiriction is there for almost every one (Atleast the one i checked). BUt added advantage with ICICI ot tata AIG, of bajaj allianze is that medical emergency even if it is out of pre-existing conditions are covered. where as the insurance companies in the US do not cover them.

    I used ICICI for my parents. My dad had to use the insurance unfortunately. Due to his age (60 yrs) they paid only part of the expense, but i did not have to pay from my pocket except the prescription medicins.


    In another case, one of my friend had purchased insurance for his mother here in US, she was diabetic, and unfortunately her kidneys failed when she was in US. Insurance company did not pay anything, as it was due to pre-existing condition.

    There are advantages and disadvantages with both. You need to choose based on your condition.

    Please remember that ICICI gives LIMITED coverage for anyone above the age of 56. It is mentioned in the "fine print". They have a restriction of say $1200 per day of hospitalization (not sure of the exact amount- but somewhere in that region).

    The same is true for TATA Travelguard

    It sounds like Comprehensive Insurance from a US company might provide the best "insurance"

    Interpretation of the law is also subjective.

    What I am trying to tell you my friend, like I have tried to tell others like you before, is this. If IV hurts my interest, I would have to be an absolute moron to support it.

    IV is working hard to eliminate retro. Everyone is supporting their effort. I welcome everyone join togeter to fight retro. IV is not hurting or helping your or my interest. Large scale, IV is trying to figt retro.

    We are simply talking what is law. How the flow of unused visas should be. It is nothing to do with fighting retro. I do not know wheathar it is IVs objective or not. Now, you are threatening that you will quit IV, if some one talks what is law. Are you asking us to shut up and help you first? Do you want us to ignore if some one hurts?     For all of you who have send me a pvt. message asking me how to reach IO @ TSC, here are the steps:

    1) Call Customer Service @ 1 800 375 5283
    2) Continue in english, hit 1
    3) To check the status, hit 2
    4) Know your receipt number, hit 1
    5) Enter Receipt number, and then for SRC, hit 1
    6) Confirm Receipt Number, hit 1
    7) You will now hear the status of your case. At this point, hit 3 to "Report a problem".

    Here is the trick - now you will hear 4 options. I believe # 3 is "If your case is outside the processing time..." and # 4 is for "If you have filed several cases and have received a decision on....". You want to hit # 4 and you will be connected to an IO at TSC.

    Just a word of caution: You will be talking to an Immigration Officer @ TSC so please be very polite. Some officers will tell you that they cannot give you any information, or you should be calling Customer Service number, simply say 'Thank You' and hang up. It might take days/weeks before you reach an IO who would be willing to help.

    Again, the sequence is:
    Call the customer service number.
    Press 1, 2, 1, Enter Receipt Number, Hit 1 for SRC, Hit 1 to confirm RN, 3 to report a problem, 4 to connect to an officer @ TSC.

    Also, you do not have to wait to hear the complete message. You can be connected to an IO in less than 30 seconds (trust me, you will get good at it). I had the print out of steps sitting in my car and I would go to my car every 2 hours and call TSC. Keep a log of when you called and who the officer was (if the officer tells you their name, note it down cuz next time you can simply hang up if the same officer is on the line).

    PLEASE DO NOT WASTE TIME CALLING CUSTOMER SERVICE, AND DO NOT OPEN TOO MANY SRs.

    I hear people say that there is reverse brain drain. But this is not completely true. I cannot quantify in numbers but there are certainly few people, I know of, who have migrated to countries like Canada and Australia.

    I will not call it as reverse brain drain but diversion of brain drain to other pastures that may be worthy from individuals standpoint.

    Reasons could be endless, to name a few - stagnancy in career growth, frustration for wait for GC, inability to invest further in housing for job insecurity, longer time for family union (ageing parents), save kids from western culture, etc.. etc.

    I have heard one of the above reasons, while there could be more, from people who want to vent out their frustations. But rest assured very few choose to put it to action at the end of the day.

    My two cents - don't bash others. I believe that all of us go through this turmoil at some point or the other.

    Let's stay focussed on what you want. Most of us, if not all, are here for better life, career growth, money ;), etc and if other countries offer better prospects and meet majority of ones expectations, most likely, we will consider the options. I think, to a certain extent, we are patriotic to our ownself or if may call - opportunist.

    Given a scenario. EU Blue card gives better option (though not sure if it will :p) flow to newer pastures is inevitable and unstoppable. This may not appeal to 100% of the readers but it's one of the faces of dice.

    I am sorry srikondoji but i have to disagree on some points.

    "You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant." .
    Yes you can do that. But you work late coz people Not dependant on H1B's can leave on their scheduled times coz if they get laid off, they wont be deported if they dont get a job in 10 days. Sure there is No Formal distinction on paper between H1B's and Non H1Bs, but it is assumed that since ur application depends on the employer (entirely), you will put urself to the grind.


    You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.

    What about people who come here already married? Now for those unmarried you have to marry a Citizen to get a Green card. Marriage is a totally seperate thing and is not something that should be used solely for getting a GC (IMHO). Sorry but i do not agree that marrying a citizen is an easier way of doing ur immigration.
