    For eg.. I was talking to my friend in India and told him about the issues here, he did not understand, he thought I am having a tough time here and told me he has some friends in US who can help me out with immigration problems. When I explained our issues to some people here, some understood and some did not, they told me they know some lawyers who are very good and can help. One of my old employer started a new company in Atlanta and contacted me and asked me to join, but I told him I cannot because I am stuck with my ppresent employer and will lose priority date blah... he did not understand that and was confused.


    I had the SAME exact problem, both, with people here (indian citizens who are now american citizens) and people back home. To the point where, once i was addressing a group of my community members and a couple of Indian american people absolutely REFUSED to belive that the Govt wud give illegals a better break than they wud give us, and that it had happened in the past. It took me half an hour and quite a few examples to illustrate how that was true.

    About all the confusion with the priority dates. I Myself am confused about this whole Priority Date Nonsense. I mean the part about processing 485's based on PDs makes sense. Why you cannot even APPLY makes NO sense whatsoever. I have tried making a short speech to convey the problem to friends and co-workers. Each time it ends up being so long winded and detailed that it just doesnt make it worthwhile. Midway in the conversation, u can feel the other person mentally Yawning ;)

    In reality, many companies who have subsidiaries abroad can use L1 visa program. But H1B offers flexibility that is much desired by many companies. (It is very less abused compared to H1B). No numerical cap on L1B may not go well with many of us. But I am very +ve that the visas are not issued in anticipatory mode like H1B. And why do companies spend 5K if they do not want to get the worker here? Do they like waste money just like that?

    Logically this highlights the real problem in the system - numerical caps. If the caps are not there and companies can get a visa-on demand, they will not spend 5K per visa on anticipatory mode. Because there is no need to do that.

    So no system is perfect. We have to minimize abuse and act responsibly when it comes to sensitive issues like immigration...

    I see only one problem in this logic! Many cases I know of, at least from the 2007 H1B fiasco, paid for the H1Bs through consulting companies FROM THEIR POCKETS. So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. (again I am not saying all do, but there are abusive companies that do).

    No cap on visa numbers will never fly... No political environment will be conducive to bringing in unlimited foreign workers without any restrictions. L1 has no caps because it is very difficult to qualify for an L1 visa, as far as I know. If caps in H1 are removed, you can bet there will be severe restrictions imposed on other aspects of the program.

    Nik,

    Did it say anything on your online account about RFE when you received the email, or you just got the email i.e. when you click on the receipt number it shows status of the case which usually shows a generic message that the case was received and is pending, so did that message change?

    If not, then did anybody else who got the RFE had that message changed?

    IV now has clout which should be immediately used for a permanent fix. Two issues which might not require laws being passed can be implemented to ease the backlog situation that will be created.

    1. Recapture lost Visa numbers- A just and reasonable demand that they cannot refuse.
    2. Remove per country cap- It is stupid to look for diversity in a category based on intellect. The whole category is created for improving America's brain power so a country cap does not make sense.

    Which is better to say" We want 10 people with OK intellect from 10 different countries of the world" or " We want 10 absolutely brilliant people-period"

    Where can I find medical insurance for my parents with reasonable coverage with reasonable premium. Their age is between 55 to 60. Obviously they are with some medical conditions like blood pressure, diabetic... like usual stuff like typical parents would have...Can somebody suggest good one... thanks in advance.

    I have used AIG for my in-laws visit and didn't had to use it. Why can't we add them to our insurance as dependants? Did anyone tried this?

    There are companies with H-1B workers who are so-called ``on the bench,'' meaning they are ready to be deployed to a project. Hundreds of foreign workers are standing by waiting for work.


    I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.

    To the best of my knowledge (correct me if I am wrong) H-1B can not be applied for contract worker if the visa has to be applied on demand and bench is not allowed.

    How will contract wokers come here in the future?

    Shouldn't they release some memo or something before making a drastic change like this???

    Don't know if this is a new procedure that they are following the main law where a valied 140 is needed the whole time.

    Hi Gurus,

    I need an advice from you.

    The situation:
    -- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)

    -- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.

    So what are my options now?

    1. Check with attorney and start defending..?
    2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
    3. What about my GC?

    Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

    I know it is a weird question. But I'd still go ahead and ask it.

    What documents that USCIS expects for a scenario like this?

    My situation: My wife still hasn't weaned off nursing completely.
    My child is 1 year 3 months old. My wife got an RFE for TB test.
    Plus she is in India currently.

    Would sending the birth certificate of child be enough to prove the existence of 1 yr 3 month old child? OR would USCIS requires doctors's input also? O do they require anything else to prove baby is still being nursed.?

    i will go ahead and give my take on this based on my experience

    1) some doctors DO NOT give a waiver since they think its OK to take a TB test during pregnancy itself, let alone not taking after child birth. so call the doc b4 you go.
    2) I believe as long as the doctor gives you a blanket waiver it should be fine, thats all the proof you probably mifght need..

    I dont think USCIS is so crude to go into getting excruciating evidence in these type of situations...good luck;)

    I would call the USCIS if first off , they could give you more time..saying that she is traveling....if not get a blanker waiver..

    Sorry for jumping the gun; it sounded like a contradiction. My bad.

    If you look at the ICE's public releases you will see they start investigating a case months before they announce their conclusions. I know in some cases the employers will be able to get away with small fines but we should not let this stop us.

    I agree. There haas to be a start. Like how Obama has promised he will make corporate CEOs accountable for the mess they create and move on, we must also jump start the community towards cleansing the system.

    The CEO level corruption, if held accountable, we will see less of layoffs etc.. and we can see the good old days permanant jobs that are "really" permanant

    High time this bill is passed. Too much fraud in L1s and H1s.Existing H1s dont have jobs and our green cards pending and no hope when it will come. They should really make L1 very very hard because I work in a huge wireless company where they get L1s from companies like TCS and they work 15 hours a day with $25 billing rate, because of which all contractors and permenant workes (on H1, GC, EAD etc) are being laid off

    I wish this bill passes with full effect


    Your emotions are understood as we are all in the same boat towards a common goal. Please refrain from making comments that give a perception to people who read it as if the whole system is rotten, it doesnt help yours and our cause..thanks for your understanding.:).. and lastly please dont name companies either. Its just doesnt help.

    One of the approaches can be for state chapters to be involved and solicit donations from local members. I liked the idea for donations from immigrants who have already obtained green cards and online ADS from google as long as we do not overdo it. I am leaning more towards funding drives. For reasons that people in the process understand better than I do, I agree that the amounts cannot be disclosed. Hence it would be nice to have offline discussions or discussions on PMs on targets between state chapter members.

    I for one am not for monthly payments or memberships. That just makes for exclusive organization and we want to be more inclusive.

    I also had another important question we need to ask ourselves. Do we want to solicit funding or donations or participation? They are two very different things. Participation is not limited to monetary involvement but can include time and ability (designing banners, websites, writing letters et al.) donation.

    Every member is welcome to contribute time and/or money. Both are important.
    Monthly subscriptions do not make this an exclusive club, they just allow IV to budget and plan future campaigns.
    Some of these campaigns will give everyone easy access to the (very exclusive) "AOS applied" club!
    The biggest campaign of them all... will give us all a quicker route to the extremely very exclusive Green Card club.

    Hi aycy,

    Completely understand. No problem. Being in the hellhole of backlogs and the gaps between jobs, benches(not a pleasant time period in consulting) etc is the worst kind of hell and under those circumstances even $10 is worth much much more than $10. Your belief in this mission is invaluable.
