Longest I have seen a 485 denial go without getting reopened is 5 months.
If a person doesn't have h-1b then six months is a magic number. If person overstys six months and uscis ultimately denies it again then person is in terrible situation (3 year bar).

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

I believe we have rights. If the million of illegals think that they have the right to stay, why can't we? Obviously, everyone has their own experiences in the US. Some of you might not have hit the "boiling point" yet and so you might not have felt the heat!!! There are people who carry the entire family here and they depend on the GC to make a difference in life. You are you and you are entitled to your own interpretation as to whether or not this is RIGHT or Privilege. I believe what LogicLife said is very true as Immigration is a movement in life. If you don't believe, you probably don't deserve it when someone said you don't. I've been here for 12 whole years, got married and bought a house. Labor subst is not the real problem; atleast it looks like a small problem now compared to the other one - people jumping from EB3 to EB2 with PD intact. I don't know if this is possible. But if possible, expect HUGE retrogression for EB2 india. I suspect it'll go back to sometime in 2001 - and stay there forever. Indians with PD 2003 or later, even EB2, can kiss their greencard dreams goodbye.

I agree completely with the OP. Education should be rewarded. People with higher education should be rewarded likewise. PhD > MS > B.XXX. If you have done masters and possess higher qualifications but had to apply in a lower EB category it is your problem or the job you applied for does not require higher qualifications. Either way, it is not USCIS prob.
I also agree with the fact the OP mentioned that MS folks and PhD folks who sweat out eventually end up losing more financially. This is the first time I am seeing some relief/reward for higher qualified people. I have seen people (have friends too) who came in 2000 straight on H1 and have been making big bucks since then and stuck in EB3. I have seen my friends port to EB2 and get GC. All this makes me feel like I have wasted 2-3 yrs in getting a masters. It is time we got rewarded. This does not mean I want others to be punished. I am saying people with higher qualifications need to be rewarded.

I should have gotten the GC before his. should I crib about it now?
Btw, I am in EB2. I made a choice to do my masters expecting some benefits. What use is the degree if it doesnt benefit me? No one would be going for MS and PhD if they are all same.

Hopefully someone from all the complainants in this forum will spearhead this initiative and hopefully there will be people out there that will stand up for themselves and join this pool
If IV can outline how it is going to help, that would really make many people come out of the shelves. However, though we talk so much, people are still scared to identify themselves against the employer. However, they may be ready to outline everything against the specific employer as an anonymous person. we got to deal with a situation where people are ready but anonymously. How can we handle this.

EB3 I is going to have a long wait. I had applied for Canadian green card and had received it. At present i have EAD and AP. Is it worthwhile to go into consular processing and work in canada or apply for a blue card or think about Australia. If this sounds okay how should i proceed.
