I never claimed any amount for this holiday gift on this thread yet but what if I want to donate $31 or per say $ 81 one time, I do not have that option now and so I will end up not donating now and wait and donate when I feel comfortable with $ 100/- or its multiplications. That is called turning away and if you guys do not see any danger into it I do not have any further words.
Fund raising is an art and I believe our current startegy is lacking that art. If you guys see the base of any major successful fund raising (Grass root level not Political ones, mind well we claim ourselves grass root level organization)you will always find donors with $ 1 to donors with $1 million donatiing as per their will. Grass root level fund raisings can not afford constraints which normally goes successful in political and/or industrial fund raisings.
Some of the strong supporters of current policy, in their argument, automatically assume that willing donor always used to spend $ 100/- frequently for drinks or food and may be living lavish life style. But they are partly wrong in their assumption...I myself never eat outside frequently. Even on a travel trip I cook my food by myself and I normally do not drink sodas or alcohol so what abhijitp has given a example at least does not remain valid for me but I can not say that it is completely out of proportion, as it has some valid logic but it can not be true for everyone.
Point is if we make a wrong based fund raising policy, we may hurt ourselves only. I know my option, if I want to donate odd figure now, I will not be able to donate it now, and I will have to wait till I feel comfortable donating $ 100/- and/or single digit multiplications of $ 100/- but would that be considered a good and wise option?
For an example, I am emotionally charged today and I want to donate $ 61/-(As I may plan that much only..for whatever reasons) but I am not able to donate so I will not donate and say after 4 months I will be able to plan $ 100/- but what if at that time I may not be emotionally charged to donate all together? And for the sake of argument if you enrolled yourself $50/- recurring, you did it willingly and so would you change to $ 25/- recurring if $ 25/-option is available to you? But with current policy we are completely turning away the people who may otherwise donate, for an example $ 20/- monthly-recurring policy may turn 40 new commited donors in whereas $50/- recurring option is creating only 10 donors and thus we may be ending up $ 300/- confirmed donation loss per month. Do whatever the F**K you want to stop us immigrants. You can't.
Nobody was able to stop your Grandpa from hopping aboard the Mayflower and landing in Ellis island and making a good life for himself. He had the might. He did it. So will we. However, I will do one thing more than that. I will teach my grand kids to respect people, no matter who they are and where they are from.
I am going to immigrate. I am going to work hard. I am going to prosper. I will bring good life to my family. I will bring value to this society and this country. I will start companies and provide my brother americans with jobs. I will help make America better.
You only make me stronger.

First and foremost, a Big THANK YOU to all the IV core team who along side their full time jobs were working behind the scenes in getting this done and having to go through the hecklers and naysayers.
A big thank you to Congresswoman Zoe Lofgren in helping pass all the pain and outrage of legal immigrants to the people incharge and making them listen.
Also last but not the least, every active member of IV who participated in the flower campaign, in San Jose rally and in actively informing media on IV projects to showcase legal immigration issues. And for keeping saner heads in the insane times.

Our forefathers travelled to the promised land in ships that were full of rats, without food or water. Several of them died while trying to reach here.
Once here on the promised land, we had to fight our way to create a free society that you are dying to be part of. America is land of entrepreneurs.
And any one that don't have an entrepreneurial spirit is not welcomed here.

So are we putting up with all the biased folks like you. We go to work everyday and earn our pay. We are not a burden to US. We contribute to the economy. We start about 25% of the companies. I can go on and on.

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. After 6 years, get nice job in India,own apartment near to office and ask your parents to live with you. Take kids to school . Have fun with them. Try to become director, AVP,VP,SVP,CEO,CTO and President. Do not go for green card. After you become director, buy a single family home and mercedez or BMW and have fun. A simpler suggestion would be to permit citizenship after 5 years of continuous lawful residence in the US...drop the word "permanent" from that law, and go straight from L-1 to USC, do not pass LPR, do not spend $10,000!:D
But seriously...It would actually fix a lot of problems for those who want US Citizenship, and because those would no longer apply for immigrant visas, those numbers would be available for those who do not wish to become US citizens.

I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.
For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.
Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007
I am filing a self-sponsored I140. So, my question is:
1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?
2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)
3) Try to wait till 2008, stamp my visa extension and then file for i-485 showing only 2007 w2.

Someone gave me a "red" with totally unjustified reason. Initially I was upset - and I complained about it - found that he gave me more reds with similar comment from multiple userids (because one userid can't give multiple green/red to the same post). And this guy is doing at weird times ..like 5 in the morning (so psyco is the right description ... now I am sure he is going to given couple of reds to me :D )
After rethinking - now I don't care much about reds - someone is just pissed off, jealous or having fun ... red might make us (and our posts) look less reliable ... however I decided to keep my blood-pressure low and psyco's high :D ..so go ahead psyco - add more reds !!

Hi,
this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.
I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.
I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.
So don't judge others just because you have been lucky enough to maintain your status...

I am really sorry about your situation. While, it is true that there is a lot under USCIS' adjudicator's control, we need to give it our best try and exhaust our options before we give up. I think that being Indian, IT and skilled (I am all 3 !) does not have that much of a bearing on one's life situations and connection to green card being approved. Case in point : I went through a rough time myself (see beginning of the thread) and even paid the price (divorce, heartbroken) for taking a chance. However, everyones situation is unique.
If you can post details of your case, then someone from here is sure to be able to give you some guidance. One last piece of advice, there is no substitute for a damn good lawyer who can get you the results. It might not come cheap though. There are instances of people having accrued unlawful stays beyond 1 year and lawyers having gotten them their EB based green cards later through CP using tricks such as waivers etc.

Visas are divided equally -country wise quota - no country can have more than 7% of worldwide quota. Countries like India, China, Mexico, Phillipines that have more professionals in the USA. So these countries get retrogressed. EB(Employment based) greencard applicants from these countries have to wait.
Rest of the world (ROW) EB2 (ROW) do not have to wait, their dates are current.

First of all hiring someone on tourist visa was illegal, You had not thought about the safety of your child while doing it and without proper background check or reference checks hiring someone for nanny or anything like that involving children can be risky. There are instances of abuse which certainly will go un noticed.
From a legal perspective, Did u have a written contract for nanny, even if you sue the person you might not be able to recover anything and hiring an illegal may land you in trouble.

USCIS does not give how many Visas they have used and how many are left
like how many unused have gone to EB3 or Eb2 etc
if its Vertical or horizontal visa distribution
they have been some Law Suits on them to give the data
