    Exactly.. You apply now.. no way it is going to get approved in time.. substitution approval takes anywhere between 4 months to 1 yr. Most common I heard is 6 months. you try to slide just under the door.. they aren't going to be happy abt it..

    1,266,264 immigrants were granted legal residence in 2006.

    159,081 immigrants who received green cards through sponsorship from their US employers accounted for 12.6% of all legal permanent residents.

    However, 87,702 (or 55.1%) of the employment-sponsored immigrants were spouses and children of principal applicants.

    The share of employment-preference immigrants has varied between 3.3 percent (59,525) in 1991 and 22 percent (246,878) in 2005.

    The other categories are family preference (802,712), refugee + asylee (216,454), Immigration Reform and Control Act (IRCA) of 1986 + parolees (43,546) and Diversity Lottery (44,471).

    Employment based immigration is legal. However, it may help to add legal to the title.

    Employment based immigration is skilled. I think employment based immigration includes cooks, priests, .... They consider themselves to be skilled just like everyone else!

    If you just ask for improving legal immigration, they will improve family based or asylum.

    As some persons learnt yesterday, legal immigration has very low priority as compared to undocumented. Similarly, employment based immigration has no priority in legal immigration!

    I feel this is too small a specimen to predict anything but so far about 25% are Jun 2003 or older...

    Below is purely my speculation!

    Assuming there are 400k applications pending (may be a bad assumption) > so about 100k with PD's Jun 2003 or less...

    10k per year allotted so 10 years to reach June 2003 :confused:

    If you look at the PD progress for EB3 I, the only movement was during March and April 07.

    and U there after.
    if the recapture bill doesnt pass, we are looking at something similar this year too, very little movement. My guess is that EB 2 I is also going to retrogress a bit, simply because of the number of applicants in that category. EB 3 ROW will also see slow movement because of the distribution pattern.

    My guess is that it will move a bit more faster than last year. Note that Apr 22 was the hump day (been dealing that that day right through labor certification phase), after that, the movement was steady. The Nov1 showing up twice is due to exhaustion of the numbers. I am expecting a steady march going forward.

    From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.

    As for you, it appears that as long as your substitution is approved before the law comes in to effect, there won't be any problem. If not approved by that date then it's kind of fuzzy as to what will happen. If you haven't filed already, just file premium and I am sure you'll have your 140 approved before the law takes effect.

    I am not using substitution labor. I do not condone any one who does it for monetary reasons.

    So the rule hasn't taken affect yet huh! I will definitely send my application out in premium processing this week. Just worried that I have passed the 45-day time period :( . Does my I-140 have to be approved before this rule is implemented, or just that my application needs to be filed ?

    Could you please at the same time also ask EB-3 ROW to quit this organization?

    First of all, my action just represents myself, not IV. Secondly, I don't really care whether EB-3 ROW would quit or join IV. To be frank with you, my PD is just 3 month away from the current date (EB2 China). From what I know now, immigration reform won't reduce my waiting time significantly. I have contributed to this organization, but now I decide to take some action of my own instead of contribute to this organization. It's quite funny that you threaten to quit this organization. This organization would benefit you much more than people like me since you are in EB3 ROW. But it is totally your call. I don't care whether you quit or not.

    Just wondering how we can make this a paid site which works and where everyone wins. Here are some thoughts in the wee hours:
    0) Read for Free

    1) Monthly paid subscription (recurring contributors):
    a) can post without restriction.
    b) get important updates

    2) If you don't have a monthly contribution -
    a) Your first 5 posts are free
    b) After that you can buy "points" to post on IV (say minimum chunk of 25 points for $50 bucks).

    To post a message, it costs you a point. If you have a question, then a couple of bucks is a small amount to have your questions answered. However, without incentive people will not answer questions (because it would also cost to post responses/experiences). So, lets say I post a response to your question, then if you (or any member who posted before me) thinks that my response was useful, and adds value to that thread, can give me a "+" which adds to my chunk of points.

    This way, only people who have serious queries will post their questions, and those who are confident about their answers will post a response. It will reduce noise on the website and will become a better resource of information. Unfortunately a lot of good stuff gets lost between people venting their frustration and providing incorrect advice.

    Ofcourse, we can make certain threads free to post - such as the funding drive, media drive, state chapters etc.
    If you really really want lots of responses to your questions, you could also sponsor a thread - say $25 bucks where anybody can post a response for free, for a limited time.

    One of the abuse is to avoid paying tax.Some big companies are sending L1 persons out of the country after they complete 11 months(If L1 persons are staying more than 1 year company has to pay tax). Now L1 and H1 are having same type of of nature of work but L1 has so much undue advantages like L2 can work, No salary restrictions, Companies can avoid taxes in many circumstances with no restrictions in rules like H1b at all. No cap also.This is also some type of discrimination in the law. In fact L1 need to be capped than H1b as L1 is playing more role in displacing USA workers but many cases in H1b is creating more jobs by innovation.

    I'm not anti immigrant. I'm on H1 (actually EAD with EB3 PD of Jan 2004).Almost got laid off with replacement by an L1 from TCS. Good for now for another 3 months!!

    If you still think against me, i wish you get a situation where you might get laid off and replaced by an L1

    I'm for reform for GC processing and I dont support the abuses because of L1s

    Hi I've been a NC victim for almost 3 years. I have heard all kinds of speculations on the real reason behind USCIS/FBI decision,like the amount of the tax you pay, your political view, your education level,etc. all influence the result. Could that be true or it's just purely a bureaucratic backlog? Something interesting to think about I guess.

    It takes realization of how important skilled immigrants are to US economy.

If what is stated in immigrationportal about the labor substitution is true, then we don't have any real benefit from the this rule, because all labors certified before the implementation of this rule are not bound by the 45-days time constraint?!? All the so called desi companies may not sell the labors, but would not spend money to cancel it either. So those old labors are going waste as they are still active.

    For all well qualified EB-3 folks it is a good and legal way of getting out of this EB-3 India mess.

    Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.

    The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number

    Hello,

    If your parents have bad health, then its a risky trip anyways .. but if they are in a reasonable health, then most insurance plans (except the super cheap ones) should be fine to cover any emergencies .... I have used k v rao insurance couple of times (but never had to make a claim) ...

    There are always bad stories about claim process, but that is just the nature of Insurance industry (had such experiences with my employer insurance as well ... despite it being a Fortune100 company with generous benefits)... so choose your poison! :)
