If we can even collectively demand official data, which I think we are entitled to, it will help IV community in estimating the wait times for individual cases. It may also help USCIS in correcting their projections and foreseeing the demand.

I think USCIS actions are too random . I do not think they want to see the real projections or the real demands. If they wanted to , believe me it should not have been difficult at all. Nevertheless, the first step towards that would be asking for transparency. The letter and poster campaign can do that.

Great discussions!! we are all going in different directions... How many Labor petitions few handful? There might be ppl who are stuck legitimately and ppl who did it , it was legal. Rather we should concentrate on Retrogression of VISA numbers. Then what after July 07 , think also about 140's there were pending there are a handful with earlier priority dates. Also many times USCIS issued GC's for ppl with earlier PD's should they return their GC back ? And potato eater has mentioned its not point to argument. I dont think there are those who are blocking the system. It is sheer number of VISA's that are driving nuts. There were also proposals that VISA numbers be applied only to principal applicants. Actions like these will have impact on final numbers.
And above all this idea is not new , It was even discussed by many members (in ~2006) when Substitution was abolished. But we are already here. We will campaign like Rajiv Khanna had said and then what discuss new proposal ? I feel its not that easy to do a change for existing ones in pipeline and USCIS has completely abolished this idea altogether.
Main action agenda: Legislation to get back unused numbers. I dont want IV to waste energy or resources anything beyond this and we shouldnt keep on discussions of new proposals. Our only point of discussion should be How to get legislative fix done.
Come to think of it, this idea has potential to fly. We can ask CIS to make the date of I-140 filing as the PD for substituted labor case. This will ensure that PD will move forward smoothly till July 07 at least. That will cover most of the long standing ( and long suffering) GC applicants and bring them relief. This will not have any other impact on the number of outstanding apps or available visa numbers etc. I guess this change in PD assignment logic can be done by CIS without the need of any new legislation.

USCIS has just released their tally of cap filings as of 04/04/2007, Wednesday. In two days (04/02 and 04/03), they received 133,000 unique pieces of mail containing H-1B petitions, which turned out to be lower than 150,000 which they had initially reported. They reached the updated number following a physical count of the mail. Each piece of mail may contain more than one H-1B petition and it will take USCIS a substantial amount of time to open and sort through that volume of mail. It is a good news in a way that at the end, the total may turn out to be less than guestimate in the community and the rate of odds for winning in the lottery may be much more promising than the one initially anticipated in the rumors.
As of Wednesday, total they sorted out and each type of cases identified were as follows:
Total Sorted Out: 32,755
General cap cases: 28,052
U.S. Master or higher degree cases: 4,703
The USCIS promises to update report from time time as they continue to sort out the remaining packages.
It is surprising that the U.S. Master or higher degree cases are more or less higher than expected.
HUM - Even if i do a liner extrapolation, there will be 19,097 US-MS in the 130,000 packets which transates that those who applied on Apri l 2 and 3 will get into the 20K US-MS quota!
This assumes a linear sampling of US-MS petitions in the above reported USCIS sample (4703 US_MS petitions in 32775)

Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

Can we rope in organizations like those mentioned in the subject line for our cause?
Single most important reason I have not bought a house yet is that I do not have a GC and thus can be kicked out anytime. Most of my savings have been invested in Real Estate in India not because I think investment there is more profitable but because I do not have confidence that I will get GC here for sure. All of my friends who own a house waited till they got GC and those who do not own one, are those waiting for GC. In short, more GCs to Desis generally would mean increased housing demand, at least that is what the initial look at numbers indicate. Thoughts?

What is even more frustrating is that we are chasing this so called American Dream during the most potent years of our lives and literally wasting our lives away.
That's exactly it Ragz. That one statement summarized it all. The MOST potent and important years of our lives and our spouses lives are going Right down the drain. I feel even worse for the spouses. Atleast we HAVE jobs and our careers are going SOMEWHERE. The countless spouses on here and even more so not on here are suffering away today for a better tomorrow. It may just happen that when the Work permits/ GCs do come thru, our spouses' skills may be extinct due to having no work for so many months/years.
This is definitely an angle to explore. As my spouse was telling me the other day. God Forbid, if this problem lasts for another year and then some of us decide to move back coz we are tired of this nonsense, our spouses will find it just as hard to find jobs in our home countries as well. Think about it, our home countries are pumping out fresh blood everyday. Will the companies select them, or someone who has been out of touch with the job scene for 1-2 (or many more) years?

Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.
IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.
We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve. IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.
We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve.
