I am afraid you are being naive here. What the OP is saying is
(1) We should all go back to our home land, because he has some opinions and positions on what is considered turning back to home land. You might not see it but he is trying to shape opinion of others very intelligently. Who says this? Some one who does not want competition here. Well, if this was coming from some one who is in India I will give him props. He is in US for 10 years and he is saying US GC system sucks and I will go to canada in 2 years. Damn it! I like US very much , i am here for around 5 years , and i believe the GC system really sucks (don't you ?)But i have some commitments in India , and if i don't get a GC in 1-2 years i will go back. All my college batch mates in India are managers now , and i am still a developer. I cant take a better job , because i don't have a GC, and with EB3 India, by the time i will get a GC, i would be about to retire :-)

Filed to TSC in January 2008 and I just got the RFE from TSC for my EB1-OR

The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.

Another IV member asked this question at a previous debate and educated me about submitting questions to the california debate. This question did not get picked up at the previous debate. Let's work to get the question picked up this time
I guess we should use chances like these to get our agenda heard by the people and the govt. There are going to be atleast 3 more presidential debates we should try to get this question asked atleast in a couple of them. We can modify the question to make it more broad, but still keep the focus on legal immigration problems by highlighting it.

Just because a large number of IV members are EB2 Indians (based on the comments posted) doesn't mean that we should ignore the interest of EB3 ROW or EB3 Indian/Chinese.

And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.

I see only one problem in this logic! Many cases I know of, at least from the 2007 H1B fiasco, paid for the H1Bs through consulting companies FROM THEIR POCKETS. So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. (again I am not saying all do, but there are abusive companies that do).
No cap on visa numbers will never fly... No political environment will be conducive to bringing in unlimited foreign workers without any restrictions. L1 has no caps because it is very difficult to qualify for an L1 visa, as far as I know. If caps in H1 are removed, you can bet there will be severe restrictions imposed on other aspects of the program.

They do this without spending a penny from their pocket and sometimes even make profit just by sponsoring H1Bs for people in India.
As a result, genuine visa seekers are denied a chance to get in and start working right away.

I have taken my Ex - employer to DOL and USCIS and I was successful getting my money back.
If you go with lawsuit then it becomes partially a Civil case rather than criminal offense.
